Protection and General Remarks
- All buyers and/or users are requested to read these general terms and conditions of sale before placing an order.
- The totalbeauty-shop.eu website, in its entirety, including its name, design, layout, text, content, and photos—is protected by copyright. No part of this site may be used on other sites without permission. Printing pages is permitted only for personal use. Unauthorized reproduction or distribution of the website or any part thereof is prohibited and punishable by law and will be prosecuted to the fullest extent of the law.
- The website totalbeauty-shop.eu is owned by Lake Jean. The website was created and is managed by Lake Jean, with its registered office at Molenweg 99, 3680 Maaseik, and VAT number BE 0790.212.676. All invoices issued by totalbeauty-shop.eu will therefore include this information.
- Total Beauty Shop pays the utmost attention to the content; however, we disclaim all liability with respect to the information displayed in any form whatsoever, as well as with respect to any direct or indirect consequences of any inaccuracies in this information and/or photographs.
- Brand names, product names, and images related to the product range are the property of the respective providers.
Terms of Delivery
Article 1 Applicability
1.1. These terms of delivery apply to all offers, orders, and agreements of totalbeauty-shop.eu. Accepting an offer or placing an order implies that the customer accepts the applicability of these terms.
Article 2 Offers and Agreements
2.1. All offers from totalbeauty-shop.eu are non-binding, and totalbeauty-shop.eu expressly reserves the right to withdraw offers. All offers are subject to availability. Prices are subject to change at any time.
2.2. A contract is formed upon acceptance of the order by totalbeauty-shop.eu. This acceptance is confirmed by a confirmation email and is binding on both parties. totalbeauty-shop.eu is entitled to refuse orders or to attach certain conditions to the delivery.
2.3. Unless proven otherwise, the records of totalbeauty-shop.eu and the delivery service serve as proof of the orders placed by the customer with totalbeauty-shop.eu, payments made, and deliveries performed by totalbeauty-shop.eu. totalbeauty-shop.eu acknowledges that electronic communication may serve as proof. By accepting these terms and conditions, the customer also acknowledges this.
Article 3 Prices and Payment
3.1. The prices listed for the products and services offered are in euros, including VAT and excluding shipping costs and any payment fees.
3.2.Total Beauty Shop charges shipping costs per country for orders as shown in the table below (including VAT); shipping is free for orders above the specified amount. Matakki scissors and furniture are not eligible for free shipping.
Pickup is always free; you will be provided with a suitable pickup address (in the Bree (BE) area).
3.3. You can pay on our online store via Online banking with the most major banks, Via Ideal/Wero, Creditcard, Mastercard, Bancontact/Mister Cash, Apple Pay or by prepayment via bank transfer.
3.4. All other invoices must be paid by the customer without any discount or offset within 14 business days of the invoice date. If the payment term is exceeded, Total Beauty Shop is also entitled to charge the customer interest at a rate of 2.75% starting from the invoice due date, with any partial month counted as a full month. If the payment deadline is exceeded, Total Beauty Shop will send a reminder and is then entitled to charge €6.81 in administrative fees. The email that the customer receives immediately after placing their order is considered the invoice.
3.5. If, even after receiving the second reminder, the customer has not paid, has not paid in full, or has not paid by the payment date specified in the reminder, Total Beauty Shop has the right to charge the customer for its extrajudicial (collection) costs. The customer is also obligated to pay any actual legal costs incurred.
3.6. Discount codes cannot be applied by our customer service team under any circumstances after an order has been placed.
Article 4 Orders and Communication
4.1. Total Beauty Shop is in no way liable for misunderstandings, damage, delays, or unclear transmission of orders and communications resulting from the use of the internet or any other means of communication in the exchange between the customer and Total Beauty Shop, or between Total Beauty Shop and third parties, insofar as such communication relates to the relationship between the customer and Total Beauty Shop. In the event of any questions or complaints, Total Beauty Shop will respond within 2 business days and will make every effort to resolve the issues.
Article 5 Delivery and Delivery Time
5.1. Deliveries are made exclusively to the delivery address specified by the customer.
5.2. Stated delivery times are provided as a guide and are not binding deadlines. Total Beauty Shop is never liable for any damages resulting from delivery times being exceeded.
5.3. Products are deemed to have been delivered at the moment the recipient acknowledges receipt of the product by signing for it.
5.4. Total Beauty Shop reserves the right to make partial deliveries, whereby an order may be shipped in two or more shipments.
5.5. Total Beauty Shop applies a minimum delivery time of 1 day and a maximum delivery period of 30 days, unless otherwise agreed upon via a notice on the product page. After this period, the consumer has the right to terminate the agreement without a written notice of default; this applies only in the event of failure to deliver complete orders; if a partial delivery has taken place, termination is no longer possible. Termination of an order that includes made-to-order, pre-order, or backordered products is not possible.
5.6. Delivery times are listed for each product and apply to that specific product or option; if no specific delivery time is listed, the standard delivery time is 1–7 business days. If you receive a shipping confirmation from us but have not received the package within 3 business days, please contact customer service. For backordered products, the delivery time ranges from a minimum of 5 business days to a maximum of 60 business days.
5.7. Voor een bestelling dient u een geldig telefoonnummer op te geven, hierdoor kunnen we verzendingen verzekerd versturen en er ook voor zorgen dat we u telefonisch kunnen bereiken bij problemen. Indien u een vals telefoonnummer opgeeft kan een zending ofwel niet verzekerd verstuurd worden of kan de verzender u niet contacteren voor een oplossing bij een defect/retour etc...
5.8. Zendingen verzorgd door derden zowel naar afhaalpunten als thuis-adressen zijn de verantwoordelijkheid van de transporteur, zij kunnen deze levering veranderen moest het bezorgadres niet beschikbaar zijn. Zij zullen hiervoor uw contactgegevens gebruiken om u op de hoogte te stellen. Total Beauty Shop draagt geen enkele verantwoordelijkheid bij fouten en veranderingen tijdens het transport.
5.9. Bij elk product staan ook de afwijkende levertermijnen vermeld. De levertermijnen kunnen verschillen omwille van verschillende magazijnlocaties en zijn enkel indicatief en nooit bindend.
Article 6 Incorrecte levering
6.1. De klant verplicht zich bij aflevering na te gaan of het geleverde beantwoordt aan de overeenkomst. Indien de klant na ontvangst bemerkt dat het afgeleverde niet overeenkomt met de bestelling dient hij, middels een e-mail naar klantendienst@totalbeauty-shop.eu , binnen 2 dagen contact op te nemen. Aan de klant wordt dan gevraagd of hij/zij een nieuwe levering wil of dat hij/zij het geld terug wil ontvangen. Ook voor andere zaken met betrekking tot bestellingen en orders gebruikt de klant het e-mail adres cs@totalbeauty-shop.eu. Total Beauty Shop reageert binnen twee werkdagen op iedere klacht of incorrecte levering.
Article 7 Annulering bestelling
7.1. Nadat de klant het door hem/haar bestelde produkt heeft ontvangen heeft de klant de mogelijkheid om binnen 14 kalenderdagen na de ontvangst van de/het product(en) de onderliggende overeenkomst met Total Beauty Shop te ontbinden uitgezonderd producten op bestelling. De klant hoeft hiervoor geen reden op te geven, daar het cosmetische producten betreft mag de verpakking niet geopend zijn en het product niet gebruikt zijn.
7.2. Indien de klant de overeenkomst binnen deze termijn wenst te ontbinden dient de klant dit schriftelijk (e-mail of brief) aan Total Beauty Shop te melden. De klant dient het product na overleg met Total Beauty Shop terug te sturen naar een door Total Beauty Shop vastgesteld retouradres. De klant dient in dit geval zelf de kosten van en het risico voor het verzenden te dragen.
7.3. Indien de klant reeds enige betalingen heeft verricht op het moment dat de klant de overeenkomst met Total Beauty Shop ingevolge het voorgaande in Article 7 van deze verkoopvoorwaarden heeft herroepen, zal Total Beauty Shop deze terugstorting bij de betaalprovider waarmee betaalt is nadat Total Beauty Shop het door de klant geretourneerde product heeft ontvangen en gecontroleerd, doorgeven en zij zullen deze binnen een termijn van 14 werkdagen aan de klant terugbetalen. De hoogte van het terug te betalen bedrag kan nooit meer zijn dan de aankoopprijs of het totaal aan aankoopprijzen van de geretourneerde producten. (verzendkosten worden in deze gevallen nimmer vergoed)
7.4. Total Beauty Shop behoudt het recht om geretourneerde producten te weigeren of om slechts een gedeelte van het reeds betaalde bedrag te crediteren, wanneer het vermoeden bestaat dat het product reeds is geopend, gebruikt of door de schuld van de klant is beschadigd.
7.5. Total Beauty Shop zal bedragen onder de 20 € steeds retourneren naar winkelkrediet en kan zich steeds voorbehouden een uitzondering op deze regel te voorzien in onderling overleg met onze klantendienst.
Article 8 Retourneren
8.1. Retourneren naar Total Beauty Shop is steeds mogelijk echter hopen we dat dit niet nodig zal zijn. Hiervoor dient u met enkele voorwaarden rekening te houden. Deze voorwaarden vindt u terug in de volgende Articles.
8.2 Alle verbruiksproducten op onze webshop (shampoo, maskers, kleuringen, spraytan, nagellak... kortom alles waar contact met huid of haren wordt gemaakt) zijn hygiëneproducten en mogen alleen geretourneerd worden als ze ongeopend (dus ook een eventuele verpakking dient nog intact te zijn) , het product dient ongebruikt te zijn.
8.3 Kappersscharen en Split-Enders worden niet teruggenomen door de wet op hygiëne eens deze gebruikt (of geopend) zijn, deze kunnen enkel op zicht beoordeeld worden.
8.4 We behouden ons het recht om een teruggestuurd Article te weigeren indien dit strookt met onze voorwaarden en indien niet de juiste retourprocedure is gevolgd.
8.5 Elk Article kan geretourneerd worden binnen 14 kalenderdagen na ontvangst dit enkel indien er schriftelijk (via mail) of via uw account, in de bestelling een retourverzoek wordt aangevraagd.
8.6 Na de goedkeuring van uw retour dienen we het product binnen 7 kalenderdagen te ontvangen anders zal de retouraanvraag automatisch gesloten worden.
8.7 Het volledige aankoopbedrag van het Article wordt vergoed (de verzendkosten en de verzendkosten van de retourzending zijn voor rekening van de klant uitgezonderd bij fouten onzentwege). Bij een retour door een fout van Total Beauty Shop wordt het volledig aankoopbedrag incl verzendkosten terugbetaald indien er geen andere oplossing kan worden gevonden. Indien bij aankoop van meerdere producten, 1 of enkele producten worden geretourneerd wordt het door ons bestede verzendbedrag hierop berekend.
8.8 Indien bij retournering (van enkele producten) van een bestelling, waarvoor gratis verzending is berekend, door het te retourneren bedrag uw initiële aankoopwaarde daalt onder de drempelwaarde voor gratis verzending zal alsnog verzendkosten van het te retourneren bedrag afgehouden worden.
Article 9 Overmacht
9.1. Total Beauty Shop is niet gehouden tot het nakomen van enige verplichting jegens de klant indien zij daartoe verhinderd is als gevolg van een omstandigheid die niet is te wijten aan haar schuld noch krachtens de wet rechtshandeling of in het verkeer geldende opvattingen voor haar rekening komt.
Article 10 Eigendomsvoorbehoud
10.1. De eigendom van geleverde goederen gaat over indien de klant al hetgeen op grond van enige overeenkomst aan Total Beauty Shop verschuldigd is, heeft voldaan. Het risico met betrekking tot het product gaat over op de klant op het moment van handtekening voor ontvangst. Total Beauty Shop draagt het risico tijdens het transport.
Article 11 Intellectuele en industriële eigendomsrechten
11.1. De klant dient alle intellectuele en industriële eigendomsrechten die rusten op de door Total Beauty Shop geleverde zaken geheel en onvoorwaardelijk te respecteren.
11.2. Total Beauty Shop garandeert niet dat de aan de klant geleverde zaken geen inbreuk maken op enig intellectueel en/of industrieel eigendomsrecht van derden en aanvaardt geen enkele aansprakelijkheid in geval van enige aanspraak van derden gebaseerd op de stelling dat met een door Total Beauty Shop geleverde zaak inbreuk wordt gemaakt op enig recht van een derde.
Article 12 Aansprakelijkheid
12.1. Total Beauty Shop kan slechts aansprakelijk worden gehouden voor schade, die aan haar opzet of grove schuld is toe te rekenen tot maximaal de faktuurwaarde.
12.2.Total Beauty Shop is niet aansprakelijk voor eventuele schade voorvloeiend uit typefouten, onjuiste of onduidelijke weergave van gegevens en andere tekortkomingen in informatie op de website, zelfs niet wanneer Total Beauty Shop tussentijds hiervan op de hoogte is gesteld.
12.3. Total Beauty Shop is niet aansprakelijk voor eventuele schade voorvloeiend allergische reacties naar aanleiding van het gebruik van Total Beauty Shop producten, zelfs niet wanneer Total Beauty Shop tussentijds hiervan op de hoogte is gesteld.
Article 13 Persoonsgegevens
13.1. Door de klant ingevoerde persoonlijke gegevens zullen worden opgenomen in een bestand. Deze gegevens zullen uitsluitend gebruikt worden voor de uitvoering van de bestelling van de klant en promotionele doeleinden van de firma.
13.2. Gegevens van de klant zullen door Total Beauty Shop niet worden verkocht of verhuurd aan derden.
Article 14 Diversen
14.1. Indien de klant aan Total Beauty Shop schriftelijk opgave doet van een bezorgadres, is Total Beauty Shop gerechtigd aan dat adres alle bestellingen te verzenden, tenzij de klant aan Total Beauty Shop schriftelijk (e-mail, fax, brief) opgave doet van een ander adres waaraan de bestellingen van de klant dienen te worden gezonden.
14.2. Wanneer door Total Beauty Shop gedurende korte of langere tijd al dan niet stilzwijgend afwijkingen van deze voorwaarden zijn toegestaan, laat dat onverlet haar recht alsnog directe en strikte naleving van deze voorwaarden te eisen. De klant kan nimmer enig recht doen laten gelden op grond van soepele toepassing van deze voorwaarden door Total Beauty Shop .
14.3. De aangeboden kado/verrassing bij elke bestelling is enkel geldig indien de voorraad strekt en zal in andere gevallen vervangen worden door een toekomstige korting.
14.4. Alle gesprekken met de telefonische klantendienst van Total Beauty Shop worden voor juridische en trainingsdoeleinden opgenomen.
14.5. Total Beauty Shop heeft te allen tijde het recht deze voorwaarden en de inhoud van de website Total Beauty Shop te wijzigen.
Article 15 Governing Law and Jurisdiction
15.1. All rights, obligations, offers, orders, and agreements to which these terms and conditions apply, as well as these terms and conditions themselves, are governed by Belgian law.
15.2. All disputes between the parties shall be submitted exclusively to the competent court in Tongeren (Belgium).
